Second Amendment
to
Declaration of Covenants, Conditions,
Restrictions and Reservations
of Shelter Lakes

THIS SECOND AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND RESERVATIONS OF SHELTER LAKES (hereinafter referred to as this “Amendment”) is made and entered into as of June 24, 1996, by and between Raymond C. Hawkins Construction Co., Inc., a Virginia corporation (the “Declarant”), to be indexed as Grantor, and Shelter Lakes, Inc., a Virginia corporation (the “Association”), to be indexed as Grantor and Grantee.

Witnesseth

WHEREAS, the Declarant is the owner of certain lots in Section 1, Shelter Lakes, as the same is duly dedicated, platted and recorded in Deed Book No. 1931, at page 700, as resubdivided, platted and recorded in Deed Book No. 2167, at page 1881, among the land records of Prince William County, Virginia (“Section One”); and,

WHEREAS, the Association is the duly organized and existing homeowners’ association for Shelter Lakes Subdivision and is the owner of certain parcels located in Section One; and,

WHEREAS, by Declaration of Covenants, Conditions, Restrictions and Reservations of Shelter Lakes recorded in Deed Book No. 1948, at Page 1015, as amended by First Amendment to Declaration of Covenants, Conditions, Restrictions and Reservations of Shelter Lakes recorded in Deed Book No. 2177, at page 1337, among the land records of Prince William County, Virginia (the “Declaration”), the Declarant subjected Section One to certain covenants, conditions, restrictions and reservations; and,

WHEREAS, the Declarant is the owner of certain lots or parcels of land described as follows:

Lots 1 through 23, inclusive, Section 2, SHELTER LAKES, as the same is duly dedicated, platted and recorded in Deed Book No. 2329, at page 1633, among the land records of Prince William County, Virginia (“Section Two”); and,

WHEREAS, Article XII, Section 3, of the Declaration, provides that the Declarant reserves the right to make changes,

modifications and/or exceptions to any of the covenants, conditions, restrictions or reservations contained in the Declaration; and,

WHEREAS, Article XII, Section 4, of the Declaration, provides that the Declarant, in its sole and absolute discretion, may annex and subject additional land to the Declaration; and,

WHEREAS, the Declarant desires to subject Section Two to the Declaration and to amend the Declaration as provided herein.

NOW, THEREFORE, in consideration of the premises, the sum of Ten Dollars, cash in hand paid, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Declarant hereby amends the Declaration as follows:

1.   The premises set forth above are incorporated herein by this reference.

2.   The Declarant hereby subjects all of Section Two to the covenants, conditions, restrictions, reservations, easements, charges and liens set forth in the Declaration, as amended hereby. The said covenants, conditions, restrictions, reservations, easements, charges and liens contained in the Declaration, as amended hereby, shall run with the title to the lots comprising Section Two and shall be binding on all parties having or acquiring any right, title or interest in the said land, or any part thereof, and shall inure to the nonexclusive benefit of each owner thereof.

3.   The term “Lake Facilities No. 2”, defined in Article I, Section 7, of the Declaration, shall include Lots 21 and 22, of Section Two.

4.   The term “Lake Two Lot”, defined in Article I, Section 10, of the Declaration, shall include Lots 21 and 22, of Section Two.

5.   The term “Properties”, defined in Article I, Section 14, of the Declaration, shall include all of the lots in Section Two.

6.   The term “Trail Easement”, defined in Article I, Section 15, of the Declaration, shall include the Trail Easement granted

to the Prince William County Park Authority located on Lots 12 and 13 of Section Two.

7.   The percentages allocated to parties in interest with respect to Lake Two Lots, as provided in Article VIII, Section 10, are hereby amended as follows:

Lot 18, Section One – 10%
Lot 19, Section One – 40%
Parcel C – 20%
Lot 21, Section Two – 29%
Lot 22, Section Two – 1%

8.   The Association, as evidenced by its signature hereto, consents to the amendments to the Declaration contained herein.

9.   The amendments to the Declaration contained herein shall run with the land and be binding on all existing, subsequent and future Owners, grantees, purchasers, assignees, and transferees thereof.
