4.   Securing Materials.

At the end of each day’s construction activity, Builder shall insure that his supervisor of construction will inspect the area of construction and will secure such materials as may tend to be blown upon the construction site and the adjacent properties in such manner that such debris shall not be free and allowed to be blown.

5.   Daily Clean-up.

Debris or litter that is deposited within the Lot or lands adjacent to the Lot during construction shall be collected each day by the crew of the Builder and disposed of in such a manner that it is not visible to people driving through said Subdivision or by the owners or lessees of adjacent lands.

6.   Breach of Agreement.

Builder and Owners agree that any breach of the above conditions may be corrected by the Association and that any expense incurred in the process of such correction shall be paid by Builder and Owners to the Association within 24 hours of its billing to Builder and Owners. If Builder and Owners shall neglect to pay such amounts within the described period, the sums billed shall constitute a lien upon the property of Owners.

7.   Timely Completion.

Builder and Owners guarantee that construction of all structures and landscaping shown on the approved plans and site plan shall be completed no later than nine (9) months after the date hereof. Owners agree to pay the Association the sum of Twenty-five and No/100 Dollars ($25.00) as agreed upon liquidated damages for extra administrative efforts for each day after nine (9) months from the date of this agreement that construction and landscaping as described have not been completed.

8.   Compliance with Covenants.

The Declaration of Covenants, Conditions, Restrictions and Reservations, duly recorded among the land records of Prince William County, Virginia, are made a part of this agreement as if they had been incorporated herein in full, and Owners and Builder hereby certify that they have read said Declaration of Covenants, Conditions, Restrictions and Reservations, understand its full meaning and agree to abide by each and every provision thereof.

9.   Compliance.

Should the Association bring legal proceedings or employ Counsel to enforce compliance with any of the terms of this Agreement, Owners and Builder hereby agree to pay and reimburse the Association any and all costs and expenses incurred by it, including Attorney’s fees, Court costs and expenses of litigation.
