(s) To enter into, make and perform contracts of every kind with any person, firm, association or corporation, municipality, body, county, state, or government, and without limit as to amount, to draw, make, accept, endorse, discount, execute and issue promissory notes, drafts, bills of exchange, warrants, bonds, debentures, and other negotiable or transferable instruments and evidences of indebtedness, whether secured by mortgage or otherwise, so far as may be permitted by the laws of the Commonwealth of Virginia.
(t) To issue bonds, debentures or obligations of the Association, and at the option of the Association, to secure the same by mortgage, pledge, deed of trust or otherwise.
Section 1. “Association” shall mean and refer to SHELTER LAKES, INC., its successors and assigns.
Section 2. “Board” and “Board of Directors” shall mean and refer to the Board of Directors of the Association, its successors and assigns.
Section 3. “Common Area” shall mean all real property (including any and all improvements thereof) to be owned by the Association for the common use and enjoyment of the members of the Association.
Section 4. “Declarant” shall mean and refer to, Raymond C. Hawkins Construction Co., Inc., a Virginia corporation, its successors and assigns, if such successors and assigns should acquire from the Declarant (including by foreclosure or deed in lieu of foreclosure) two (2) or more undeveloped Lots for the purpose of development or construction.
Section 5. “Lot” shall mean and refer to any plot of land shown upon any recorded subdivision plat map of the Properties with the exception of the Common area and streets dedicated to public use.
Section 6. “Member” shall mean and refer to every person or entity who holds membership in the Association.
Section 7. “Owner” shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Lot which is a part of the Properties, including contract sellers, by excluding those having such interest merely as security for the performance of an obligation.
